alimony

My ex husband (married 30 years) and I had a settlement agreement which provide he pay $1000 per month permanent periodic alimony. He is taking an early retirement from his job and will receive a $400k retirement package. Today he informed me that he was no longer going to be paying alimony since he is retiring. Can he just do that?

First, review your Marital settlement agreement to determine if there are any provisions regarding retirement, pension division or alimony. I would suggest you have an attorney review these documents.

If the agreement is silent, then no one can stop making alimony payments simply because they retire. If he stopped you can go to the Court.

With $400k, he can afford the alimony. No, he can't just stop paying you. You need to file a motion for contempt if he stops the payments. Let me know if you need my help.
