It does not matter how long he has been separated. In Florida you must file a Petition for Dissolution of Marriage. If they have been separated that long, there might be very few issues. Your Boyfriend should contact an attorney for help.

He will need to file a Petition for Dissolution of Marriage, preferably in the county where he and the wife last lived together.

Separated does not mean divorce so he will have to petition the court for a divorce. Contact my office for free consultation 727-446-7659

I wish it were that simple. He may be divorced if the other party filed - you might check the court records in the county in which he and his wife last lived together as man and wife. Otherwise one of them will need to file for a divorce. If you need assistance, please contact my office for an appointment.
