Changing my sons name

My ex husband was not present during the time of birth. Nor pretty much afterwards. He did not sign the cert. I want to change my sons last name to mine. He was born in a diff state. But only has his birth cert with that state nothing more. I want his last name changed! I have poa saying that my ex says it's okay to change it. Can anyone help me?

Since your son was born in a different state, you'll have to file a name change petition. You'll have to serve his father, but I think most judges will agree that the POA will act as his consent. You should have no problems, but it would be best to go through a good family lawyer.
