child support, joint legal & physical custody

During my husbands divorce, he and his ex-wife were awarded joint legal & physical custody of their only child. My husband was ordered to pay child support that was equal to half of the medical insurance expense and half of the child care costs. My husbands ex-wife no longers carries the health insurance - we do & still pay the same child support. To my question, his ex-wife is considering moving out of state and will leave my step-son with us. Should we request a modification of the court order indicating who has custody? I assume we definitely should request a modification of the child support order - we do not want any child support from her.

Yes, you should petition for modification of custody as well as support. She is obviously only going to have visitation rights. I suggest you spell out everything in the agreement concerning not just when but how and where visitation will take place (mode of transportation, allocation of the expense, etc.).
