Legal Question in Family Law in Florida

My ex has continued to live with her parents without paying part of the mortgage and subsequent bills while receiving the Court Ordered alimony and child support that was based on her financial affidavit of living on her own. This has gone on for seven months and she still has no desire to move out with my two sons on their own. Is there any way child support being decreased since the financial affidavit that she completed is incorrect?

Hello: Child support probably could not be modified unless the income on her financial aff. was false. However, alimony is based on income and expenses. As such, if her expenses are substantially changed, it may be modified. You have to file a Petition alleging a substantial change in circumstances.
