Custody rights of unwed couple

My daughter is four weeks old. Her father and I never married, and are now not ''seeing each other'', but we are friends. Her father comes over to see her fequently. I was wondering, even though he signed the birth certificate, if he has the right to take her. There is no court appointed child support or visitation rights. I'm not concerned that he would take her, but do I have to go to court to get custody of her?

The "father" has no rights in this situation. It is he, and not you who must apply for relief from the court.
