Legal Question in Family Law in Florida

custody

I had temporary custody of my daughter 14 years old for about two years due to svere drug addiction of her mother. Before returning custody her mom was supposed to get a hair folical test and I am supposed to pay. Today we went to court and the judge said to go for the test. My ex wife is trying to go to a test at home company at 134.00 (dont trust her) and its almost double the price that I have found.I found a testing facility that will take walk ins it is local and only 75.00. what can I do to change this?

Re: custody

I'm sure you're more upset about the accuracy of the test and the exposure of your daughter to a drug addict than you are about a lousy $59 difference in the test cost, or at least that's what I hope. I know money is money, especially when times are tough, but you want to be complaining about your daughter's safety, not the money, when you bring this up to the judge.

If the order doesn't specify that the test not be a home drug test, file a motion for clarification of the order. I've never seen a judge accept a home drug test. Do this quickly because you're in a bad spot. You know the test will be fake (or she would be going to the testing center), and you're going to want to withhold custody from her until you get a real drug test. Withholding custody could get you into really big trouble, so you need to get back to the judge before that home test comes back clean.

You probably ought to get a lawyer as soon as tomorrow, if possible. Your daughter's safety could be at risk.
