Legal Question in Family Law in Florida

My daughter had a baby with someone she never married. She never lived with him and has not dated him since the baby was about 9 months old. He is now 6 yrs old. The man she had the baby with sees him about 2 to 3 times a yr. Never unsupervised. He has never paid child support at all. For years he had warrants for dealing drugs and driving without a lisence. When my daughter was pregnant with the baby, the dad was arrested and served time in jail for dealing drugs. It was a felony for selling to 2 undercover cops. He has previously served a yr. or so for assault. and recently he was arrested for failure to appear for driving without a lisence and having pot on him. He was on house arrest for 6 months. He has never held a job except for about 4 months when he got out after the baby. He now is threatening to get custody from my daughter. Is there a chance at all he could. My grandson spends a lot of time with us because I teach at his school and drive him. His dad wants unsupervised visits or possibly my grandson to live with him. no warrents now so my daughter is worried. Please help We live inpinellas county, fl.

Unless he files for visitation he has no rights to this child. I suggest you have your daughter contact the Dept. of Revenue and file for child support. Please note that even if she wins and he has to pay child support HE would have to file for visitation. At the time he goes to the trouble and money to do that rest assured he will not get unsupervised visitation. Since it is obvious he can not stay off drugs with his arrest record.
