Legal Question in Family Law in Florida

Divorce

I got a DUI and had to spend 60 days in jail. While there, my wife sold all my tools, furniture, car, refrigerator, W/D and mainly, a new central AC unit ($10K) Since she moved out and left the house stripped bare, do I have recourse to go after her or press theft charges? The house is in both of our names, but not the mortgage loan. Now the house is on the market and it's not selling and the price has been cut to half the mortgage.

Re: Divorce

You didn't say in which state this occurred, but in Florida it's not a crime for a spouse to sell marital property and keep the money from the other spouse. However, a Florida divorce judge probably wouldn't look very kindly on what she did if there were any assets left to split in a divorce.
