Legal Question in Family Law in Florida

possible divorce

I need to find out if I can receive financial support from my husband if a divorce takes place. He has admitted to extra marital affair and is currently using illegal drugs, subjecting me to a great deal of stress and I feel emotional abuse dealing with this behavior. I have had him in a VA sponsored substance abuse program for the past 5 years, but he keeps going back to the illegal drugs and expecting me to accept it. I only make $200 a month and there is no way I can support myself without his income, but I can't stay in a marriage just for the money and have to put up with his lifestyle. Do I have grounds for receiving alimony should I decide to file for divorce?

It is possible that you would qualify for some form of alimony. The basis for the alimony will be wether it is equitable and fair and will have little or nothing to do with his actions and addictions.

It is really not possible to give you definitive answer based on limited information and in the confines of this forum. You should really consider seeking an in person consultation with a family law attorney. Based on your income, you may even qualify for legal aid. Check with the Florida Bar for the legal aid office in your area.
