Legal Question in Family Law in Florida

My exwife is trying to get visitation. I have lived in a different county for the past 8 yrs. For her to get visitation does she have to petition the court in the county I live in or hers?

In that type of situation, venue is proper in either the county where the divorce was finalized or in the county where the child lives.

While it would probably be technically proper to file in either the county where the divorce was finalized, or either county where either party resides, it would make the most sense to file in the county where the children reside. If venue is going to be contested, the Court will most likely go with the County with the strongest ties to the children.

If you opt to proceed without the assistance of counsel, be aware that you will not be entitled to a do over if things go badly.
