Legal Question in Family Law in Florida
Giving up Parental rights
My friend has not supported his child or visited child for 6 months- His ex wants him to sign an agreement she wrote up stating he will give up all his parentl rights (ie no visiting, no contact, no child support) and she will waive all support from him. There is no court agreement on support or custody. Can she go into an agreement with the father terminating support and parental rights. Will she be able to come back in the picture a year from now and ask for support because she has hit bad times financially? He does not want to have to worry about her going after him for child support payments she waived from him. She is looking to move out of state with the child. Will this agreement between the two parties stand up in a court?

Re: Giving up Parental rights
I am assuming that the agreement is based upon FL law. In FL a parent cannot usually waive a child's right to parental support, and it is highly unlikely that the court would enforce such a contract. Your "friend" could, by signing this agreement, waive his right to visitation, and still be forced to pay child support at a later date. Good Luck.
