Legal Question in Family Law in Florida

Hello,

MY husband and I are separated. We have been married 4 years and have no kids. Eventually he will file for divorce. If he does, I will never respond as I don't want to divorce him. I have no interest in any of his assets, but he only has a home that’s paid off but is under his and his father’s name. There is also our homestead home with a Mortgage on it, the home is under both of our names on the mortgage, but I had quitclaimed deeded this property to his name per his request a few months ago. My question is: How does the court goes about this mortgage and a non-responded Divorce? Will he be asked to Refinance? Or will they live my name on the mortgage if I don’t respond? I am not worried about my name being on the mortgage after the divorce as he is very responsible and has money and he has always been the one paying the mortgage.

If you are served and do not respond within 21 days the Husband wins any and all he has asked for in the suit papers. The divorce will be granted since you have not filed an objection. See an attorney or County Legal Aid office immediately.
