Legal Question in Family Law in Florida

My husband has been covicted of 2nd degree murder and numerous domestic violence charges. We have never had a good relationship but we have two kids and then I have one that is not his. He used to give our two year old beer and hit my oldest child he has also hit me infront of all three kids.We recently were seperated for 8 months now he has convinced me to give it another shot my family said if I move back with.him they were going to take my kids so they would be away from us and our violence. Is it possible the could win custody of my kids?

With a background such as this the State could step in and remove the children to foster care or relative care. I do not recommend this action.

The simple answer is that it is impossible to say. The Florida Dept of Children and Families are required to investigate credible complaints; if the family complained they probably would investigate, and if they thought thewre was potential harm to the child remove the child from the home on a temporary basis. The ultimate decision is up to the Judge
