Legal Question in Family Law in Florida

If my husband passed out during cyber sex and I have pictures of the incident (so I didnt hack into his email accounts) can that be used against him as adultery?

It can be used as evidence against him but:

1) It doesn't really count as adultery, since he really wasn't having actual sex with another person and

2) Nobody really cares much about adultery in a divorce anymore. The only way it woulod probably be relevant would be in a custody case in some way which involved the kids, i.e., they saw it happen.
