injunction over, what are my rights?

I had an injunction placed on me last year and expired this year. I want to go back to my home, which I own with my husband (which will be my ex husband soon) but he now has his girlfriend living there with him. What are my rights right now? I have not signed my divorce papers yet because in the agreement, it says that he will have primary use of the home since it is the primary residence of my son until it rents. How can I get them out of there so I regain use of my home before I lose it since I cannot afford to live elsewhere? keep in mind...I have been PAYING for the house in full but not living there for the past year because he is currently only working part time and supposedly cannot afford to pay for the home...

File a motion for temporary exclusive use and possession of the marital home.
