Legal Question in Family Law in Florida

Legality of expired notary stamped letter.

Can a letter written by biological mother stating she wants joint custody and releasing child support payment, still hold up in court if the notary stamp on the letter is expired?

Re: Legality of expired notary stamped letter.

Technically no, because the notary's power has ceased. However, as a practical matter a court could view it as an oversight on the notary's part and it appears that the mother did not act in bad faith. So unless the issues absolutely revolve around the expired notary seal, the judge just might find "no foul."
