Legal Question in Family Law in Florida

I have been married for 12 yeas now with 3 boys in common, but my husband is failing to sleep at home. He goes for work or school and he does not come home to sleep. This situation it's been going on for years and I am tired of it, I know I deserve better than this. I recently moved to FL since he was recently released from army, but without him I wont be able to pay the rent and all the bills and I am struggling economically, I want to leave to NY since I have family there, however, I will need to sale my furniture because I don't have the money to take it with me. I told him to get his own apartment and do his life, which hopefully he will do eventually. My question is: Can I sell the furniture and with that money leave to NY? He says that if I do that he will sue me and I will get in trouble...is that true? I really need to know what choices do I have to get to NY.

You cannot relocate with the kids unless you get his written consent, or a court order. You should file your case asap if it is your intent to move. Also you have a case for alimony.
