Minor Fathers Child

My son is a minor=just started his senior year of high school. His 19 year old girlfriend has told us that she is pregnant and will not consider abortion or adoption. Is my son legally responsible? Can he be held responsible since he is a minor for child support etc.?

Hello: I read your question. While I have not researched the issue of whether a minor can be a party in a Paternity suit, my gut feeling is he could be. She would have to file a Paternity suit. He would be served with the Complaint and would have 20 days to file an answer. He could demand a DNA test be performed on the child and the parties.

In a Paternity case, the issues to be decided, other than who is the biological father, is the amount of child support and the non custodial parent's visitation with the child.

It might become an issue where the State comes in and removes the child if the parties are incapable of providing proper care for the child. Again I have not researched these issues, but I have handled numerous Paternity cases where both parties are adults. 'Hope this helps. Tom Rosenblum
