I have a newborn baby with my fianc� whom I've been living with for 1yr .weve been having problems lately at home where he yells at me a lot ,calls me names n even the cops were called the other day .he has
told me to get out of the house n I told him I'm not leaving without my baby then he said if I take my baby it's considered kicknapping.i need advice on knowing my rights please

If you are not married to him and he has not filed a petition to establish paternity or you haven't signed an acknowledgment of paternity (that is not the same as his name being on the birth certificate) then he doesn't have any rights and you have sole custody of the child.
If not married to him then he has no rights until he gets a court order, so you can do what you want.
