Legal Question in Family Law in Florida

paternity

My son is filing for divorce. His paper work indicates a child was born of this marriage. The child was born in April 07, he was married June of 07, 2 months after the birth. Does this matter? Does he need to put somewhere in the paper work that he and his wife both agree that he is the father of the child?

Re: paternity

Better than saying that he and his wife "agreed" that he is the father of the child, he should just follow the normal paperwork and "say" he is the father of the child. It will then be up to the mother to dispute that he is the father, which is difficult when they were married and treated the child as their own. If she doesn't dispute it, he automatically becomes the legal father, and they can proceed to the decisions about timeshare (who gets custody and visitation) in the divorce.
