Legal Question in Family Law in Florida

I have received a contempt of court notice for child support. It mentions a court date and a purge statement. I am unemployed as my back is deteriorating and am currently in the process of obtaining disability income. Will bringing proof of my disability process enough to prove my non payment was unwillful?

It may or may not prove it, but it sure as heck won't hurt your case.

It won't hurt- but typically until you are actually declared disabled and are receiving disability the court will not reduce your child support and will still find you in contempt. Usually if you go to the hearing with $500 you can meet with the attorney for the Department of Revenue before you get called in to the hearing and come to an agreement to pay the $500 and avoid having an actual hearing.

You have to file a petition to modify the support. Use of a lawyer is recommended.
