what happens if you are not there when being served with papers?

Your question leaves some loopholes but the basic answer is the Sheriff can serve almost anyone in your home in your absence. If you are concerned you need to check with an attorney right away becuase when papers are "served" you generally only have a few days to take some action or you lose by default. If you have any doubt please do not take any chances, call a local attorney right away.
