Legal Question in Family Law in Florida

Step Parent Adoption: bio father not married, no support

I wish to adopt my wifes 2yr. old daughter. Her biological father was not married to my wife, pays no support, is not on the birth certificate, is not in contact with mother or child. What do I have to do to become her adoptive parent/ legal guardian? where can obtain the paperwork? Do we need the bio fathers consent? Thank You

I agree with attorney Martin. It is best to obtain the biological father's consent if possible.

You can obtain adoption forms approved by the FL Supreme Court at the county Clerk's office, various web sites, including the Supreme Court's site, legal aid offices, Fl Bar Assoc., etc. Although it appears that paternity of the child is not legally established, you can avoid any later legal problems caused by the "biological" father by obtaining his consent to the adoption. There is a form for his consent.
