Taking a child out of state

I am separated from my husband and cannot afford a divorce at this time. I am thinkin of moving to another state. Would it be considered kidnapping if I did take him out of state. I have had custody of my son since we split about 9 months ago.

You can't kidnap your own child. However, be aware that, if your husband files for divorce, you are forbidden from moving out of state without his permission or permission of the judge. Your rights change when a divorce gets filed.
