My wife has moved out of the house and has left some of her stuff in the house and I have asked her to remove it from the house for a month now and she has not, what is my legal right to keep or throw it out?

Do not throw it out, because doing so can come back to haunt you. You probably need to file a divorce. The divorce cannot be uncontested unless everything is agreed upon and one of the issues could be her getting her personal property.
