Legal Question in Medical Leave in Florida

fmla and maternity leave

I am already on FMLA, intermittenly, because I am pregnant and I was very sick in the beginning of the pregnancy. I have 360 hours left of FMLA leave.I am now 25 days away from delivery and have told my employer that I wish to start my maternity leave on Dec. 22 and was denied because he states the office will be too busy for me to be out that week. That is a week away from my due date and my question is: if I am already on FMLA can he deny when I choose to be out?

See the form at http://www.dol.gov/esa/regs/compliance/posters/fmlaen.pdf. There are certain circumstances under which the employer can deny the taking of leave. But if you met the requirements, contact an attorney for further assistance.
