Legal Question in Medical Leave in Florida

In the State of Florida, a woman tells her employer she has a doctors appointment for her 13 y/o son. The employer states if the woman does not show up on that day of work she is consuidered to have quit. Is this a violation of the FMLA. The company has less than 50 employees.

If the employer has less than 50 employees, the FMLA has no application. However, while federal law does not apply, state law may. You may want to consult with an attorney in your state to discuss this situation.
