Legal Question in Federal Tort Claims in Florida

Child choosing parent to live with

I live in Fl w/ my 2 children. Their father in CA says that at 12 they can choose which parent to live with and has convinced my son to move to Ca. Is this true? What recourse do i have as i am not in agreement with him moving at this time.

No. Assuming that your divorce and custody order is from Florida, at 12 your son does not get to choose where to live and he would need a court order to obtain sole custody or require a move. I would guess that California law is not any different in this respect.
