Legal Question in Federal Tort Claims in Florida

Last May VA hospital resident neorologist treated non-service connected veteran w/seisure disorder for depression after a consult for peripheral neuropathy with med not for patients w/seisure disorder. We believe med caused Vet to become manic and suicidal and also increased seisure activity. Vet took med 3 mths. had major seisure which caused chemical imbalance sending vet into acute renal failure w/hospitalization and dialysis for two weeks. Vet still manic VA psychologist believes med caused manic disorder. In March of this year Vet sought med. care at another VA hospital for back pain had seisure in waiting room, I advised staff he was having seisure it took almost 30 minutes for staff to remove him from waiting room and nothing was done to detemine cause of seisure. We were advised by DAV to file tort against VA for both incidents. Vet is now a resident of NC, how do we proceed?
