Car towed illegally

My daughter's car was towed in the middle of the night because it was claimed that the tags had expired, and that was not permitted by the Home Owner's Association.

In fact, the tags had not lapsed but had been renewed days before the tow.

She was charged $140 which I understand is above the permitted price to tow a Jetta.

I hesitate to charge fraud & collusion between the HOA and the tow firm but that's what it looks like.

Do we have any recourse?

Check your HOA documents which should contain guidelines on this. If they were in error and refuse to reimburse you - you can file an action in small claims court

Towing is often connected with shady characters, but you are probably better off just moving on because they make so much money they can and do fight their legal battles.
