Legal Question in Civil Litigation in Florida

Default Judgement

I agreed to a settlement because I could not afford to fight it. I can't pay the agreed upon payments. I was sent a 1.977 form by the plaintifs attorney. Can they force me to fill it out, and If i can't pay and have no assets what is the worse case scenario. I live in Florida.

Yes, you are required to fill it out and the court can hold you in contempt if you fail to do so. If you cannot pay and have no assets, then there is nothing for the plaintiff to recover. If you acquire assets in the future, then the plaintiff may execute on those assets. Florida has a lot of protections for people that owe others money. O.J. Simpson lives in Florida for a reason.
