Employer witholding paycheck ; payroll deduction

When I quit my job,my employer refysed to give me my paycheck on the following payday stating that he was holding it because he was waiting to see my Co. cell phone bill. I informed him that we have no agreement on any payroll deductions for the phone , plus...I had a second paycheck coming. He still refused to release my check which caused me financial embarrassment. I have a family and he knows this. His claim that he was going to wait for a week to see what my personal calls amounted to would be a deduction that I never authorized.....After repeated phone calls he released 40 hrs. @ min. wage with my insurance and tax deductions....10 days after payday...bottom line.....he zinged me for about $100.00 for alleged private phone calls without any documentation.....3 weeks later. Can I litigate this matter??????

You can litigate virtually any matter, but keep in mind that the fee to file a lawsuit alone will be greater than the $100.00 in dispute. Of course, if you hire a lawyer, you will incur attorney's fees that will also exceed the amount in controversy. Good luck.
