Legal Question in Civil Litigation in Florida

My husband's friend own a business and his credit was bad. He needed money to keep his business going. He ask my husband to help him out. My husband agreed out of good faith to help him and open 2 credit cards on his name (One with Bank of America and the other one with Discover) and gave him permission to use them for his business (he had both cards on his posession). My husband frined signed off a paper to my husband were he said he is responsible to pay for the credit cards. He has been making payment to Discover but not to Bank of America. We own an account with BOA and they were withdrawing the money to pay for the cc from our account. When we realized it, we went to BOA and asked them to stop the withdraw because my husband friend is the one who is supposed to pay. We contacted him and asked him to make arrangements to make the payments, but his has not done this. My question is: Can we take him to civil court so the judge order him to assume his responsibility and pay? What are our options?

Yes, you can sue him for failing to pay pursuant to your agreement. You still owe BOA, though
