Legal Question in Civil Litigation in Florida

Lost Bracelet in Retail Store

While shopping in a retail store, a bracelet that I was wearing fell off of my wrist. I realized that it fell off and I searched the store for it. After not finding it, I left all of my information with the stores assistant manager and asked her to call me if it was found. As I was doing this, she was told by another employee that the bracelet was found by the store manager and that it was in the store safe. I waited for her to go and retrieve the bracelet from the safe. She returned and said that it wasn't in the safe and that the manager had gone home for the day.

Bracelet was never in the safe. I called a dozen times. I returned twice. No bracelet.

What can I do?? Is the manager resposible??

Re: Lost Bracelet in Retail Store

You do not mention the value of the bracelet. If it is costume jewelry it is not worth the aggravation. If it is valuable I suggest a report to your local police department. Their presence would get the attention of the store manager. If you have a Homeowners insurance policy you should report the loss to your agent. Collecting depends on the policy provisions limitations and deductible for scheduled and unscheduled personal property.

A complaint in writing to the Store detailing the managers indifference might also do the trick. Your verbal complaints are too easy to ignore.

In Florida there is a Statute providing for treble damages for Civil Theft. If you feel the manager has your bracelet you should consult an attorney to determine if the facts warrant following that procedure. You should not accuse the manager without just cause.
