Legal Question in Civil Litigation in Florida

Mechanics Lein

I need to know how to go about filing a lein on property that has been remodeled by my business and we cannot seem to get paid for the work done. I have been very patient and have given this individual ample opportunity to pay the agreed upon amount. I get promises but have received no payment. Unless there is another route to take, I would like any information on this process. Thank you.

Your questions is much more complicated than that. I usually give my client's an entire form to fill out to determine if you are even qualified to file a lien. If you file a lien and you are not permitted to it could be deemed a fraudulent lien pursuant to Florida Statute 713.31 and you could be responsible for the full amount of the improper lien plus attorney fees to the Owner. I highly recommend you contact counsel immediately especially since there are time frames which must be strictly complied with.
