Legal Question in Civil Litigation in Florida

hi there! my mother has been an alcoloholic for 13 years. she lost her job and her car. she has nothing and does nothing. she is sucking the life out of my dad who can not afford to divorce her because in florida it is 50/50. she won't leave the house. she has done nothing but cause emotional and mental abuse for the past 13 years, she only gets along with my brother and she is civil with my dad, my sister and i do not get along with her and we want her out and my dad does to but he doesnt know what to do. my sister and i are in counseling for the abuse she has put us through. we have asked her to leave, my dad has told her she had to leave but she knows that by law she doesnt have to. we just dont know what to do anymore, my dad is trying to find a way around the divorce or even a way for him to get more out of the divorce. do you have any ideas?

Contact an experienced divorce lawyer. Marital misconduct can be considered by a court, especially if it causes a reduction in the parties' marital assets. Child abuse can take many forms. Allowing it to continue when a spouse is aware of the other spouse's actions can put both of them at risk. I no longer handle these type of cases, but there are many well qualified attorneys out there who can do so.
