Legal Question in Civil Litigation in Florida

Process serving

My husband was served for a civil action on May 8. His ex-wife was named on the suit and they left notes on her door of her Florida home but have been unable to serve her. She lives in Florida part of the year and Canada the rest. My question is this, she was just served today (saturday 11/11). Is there not a time limit as to when someone can be served? Thank you.

The summons expires after a certain time period, but it can be re-newed. Assuming that the plaintiff was reasonably diligent in trying to serve the summons, then there is probably not a problem with the delay. You and your husband may want to consult with an attorney.

generally speaking, the answer is no -- particularly with the notes having been left that would have alerted her to the coming subpoena.
