Legal Question in Civil Litigation in Florida

sexual assalt at school

my 13 year old daughter was sexually assaulted at school by another male class mate. The boy was arrested and suspended for 10 days but I don't feel that this is enough punishment to teach him a lesson. As far as he is concerned it is just a vacation from school. What are my daughters rights?

Re: sexual assalt at school

You should consider both criminal and civil action by consulting with an attorney immediately. The schools are totally inept to handle these types of problems. The facts are important. Is your daughter truthful? Does she have any physical or psychological injuries? Can she handle a court case? You need professional advice before making a decision.

Re: sexual assalt at school

I would have to speak with you to determine exactly what you mean by sexually assaulted, and to learn all the relevant facts that might give rise to a cause of action against the school and other parties that may have liability exposure for the wrong suffered by your daughter. The situation you describe is complex and would require an in-depth consultation, and not merely an excahge of e-mail. Please contact my office at your earliest convenience if you are serious about pursuing this matter, protecting your daughter's rights and taking steps to ensure this does not happen again. I can be reached at 305-445-0937.
