Legal Question in Civil Litigation in Florida

truck damaged

My husband took our truck in for a repair. While being repaired it fell off the lift. The amount of damage is between $4,800. -$6,800. The dealership is willing to make the repair. My question is, is there any legal action we can take? You don't expect to take your vehicle to a dealership and have in involved in an accident.

You have a right to be made whole. If the dealership is offering to repair the damage, that seems fair. However, if then you are left with a significantly depreciated vehicle because it has sustained significant damage (for example, the frame is bent), you may not want them to just repair the damage. The alternative would be to request the "total" value of the vehicle (pre-damage), and request they give you that instead. You could then, presumably, take that money and buy a replacement truck (same model and year, same value as the old one). I can see how this could be a viable alternative solution, under certain circumstances. It mainly boils down to the numbers and the kind of damage done, but I would take all the facts to an attorney [or at least a trust worthy car dealer friend, if you have one] to have them review it before deciding either way.
