Legal Question in Health Care Law in Florida

Has my doctor and his office committed fraud/

Our doctor told us inour initial phone call over two years ago that they accept our insurance. We've had many visits and they have accepted our co-payments every time. Now they've sent me statements totaling nearly $500 because they can't get paid from my insurance company...because they were never part of the network. We let them know from the start who our insurer is and it is also on our intake form for our first visits. Is it legal for them to have accepted our co-payments, in the name of our insurer, and now expect us to pay what they billed for? We were totally honest from the start and they were not, in the least! Thanks for any advice you can give me.

Was he ever with the network?

You probably have a decent claim for fraud in the inducement because they told yo something that was false (the doctor takes your insurance), that you relied on in deciding to go to the doctor, and you would have gone elsewhere if you had been told the truth. Go in and talk with them to try to clear this up.
