Detained Immigrant for Late NSEERS Registration

My husband was detained in Tampa today at his NSEERS late registration interview due to being out of status. He overstayed his visa six years ago. We were told he would not be detained because of our pending I130 and I485, yet he was. What do I do now? How do I get him out? Help!

Young lady, please stay calm -- that is the first step, okay? Now, if your husband was detained, and he has no criminal convictions, and has a pending adjustment case, then a good immigration lawyer should be able to obtain a bond for him from USICE or motion for a bond before the court. Unless he has an old order of deportation that is outstanding, it is likely he will appear before the immigration court. Please, whatever you do, find a good immigration lawyer and have him sit with you and explain the process. The entire immigration scene is totally foreign to U.S. citizens and should not be -- but then, that's our fault for not paying attention to what could happen to noncitizens.
