Legal Question in Immigration Law in Florida

following-to-join

My mom is an US Citizen. She filed a I-130 for me (unmarried son over 21). It's waiting for approbation. The point is, I got married 2 months ago (we're living abroad now)

Have I change from preference F1 to F3 now to apply for following-to-join benefits for my spouse when I get the LPR ? or

Can I leave the petition on F1 and later when I get the LPR and then apply for this benefit ?

In others words, is this possible ?

-Application already filed I-130 preference F1 on my behalf.

-Already married abroad.

-Leave the petition as it is now (F1)

-Wait for the petition to be proccesed.

-Move alone to US and get the LPR.

-Apply for following-to-join benefits for my spouse.

If this not works, How can be the proccess ?

You asked many questions. I will address the important ones. I think you should notify US CIS of your marital status and ask them whether a new petiton is required. Each offcie has its own policy, that changes over time.
