Legal Question in Immigration Law in Florida

Juvenile Criminal record

Can Immigration pull my juvenile records from the state of indiana (class D felony) when applying for permanant residence. Are they confidential? If i expunge my records would that help? I was never charged as an adult.

Thank you

Re: Juvenile Criminal record

Whether or not immigration can pull your records is irrelevant. By signing an immigration application you are swearing under the penalties of perjury that you are telling the truth. Therefore, if the question asks have you ever been arrested, charged, etc., you must answer yes. It does not help if your record is expunged. Remember though, that in most cases juveniles are not "convicted" they are "adjudicated," so it might be in your case that you could answer honestly that you have not been "convicted." We would need more facts to know if that applies to your case. I recommend hiring an immigration attorney to help you with your application. Please feel free to contact me directly.
