Legal Question in Immigration Law in Florida

I m an American citizen and married a Canadian citizen in December 2008. Days after the initial interview with INS, he left me and moved out. He received a conditional working permit and is waiting for the permanent card. I plan on divorcing him now, as he refuses to speak with me. If I divorce him and not appear at his second interview, will he automatically forfeit his chance for a permanent residency card?

If he is approved at the interview, he will get a conditional green card. After divorce, he can apply to remove conditions by himself without your assistance. His application may or may not be granted, but there is no automatic forfeiture unless the government proves that it was a marriage fraud.
