Legal Question in Insurance Law in Florida

Representation on recorded line, part of Contract?

I called my annuity company to ask for the balance, they said they would backdate the paperwork and the value would be $160k. This was said on a recorded line. Now they said they made a ''mistake'' and its only worth $150k. Does a representation made on a recorded line become part of the contract?

Re: Representation on recorded line, part of Contract?

Probably not. However there are a number of pending cases against annuity companies for misrepresentations in the sale of the products to inappropriate persons and with large redemption penalties. I have recently obtained a substantial settlement on a particular case subject to confidentiallity. Suggest you check with "The Insurance Forum" or other sources regarding your company and policy.
