Legal Question in Intellectual Property in Florida

Allleged Duke Trademark Infringement

Our company sells two t-shirts referring

to the duke lacrosse scandal, and we

have received a cease and desist letter

from Duke University. We (being non-

experts of course) believe that the

shirts are a parody, and do not violate

Duke's trademarks.

The two images on this webpage are

the ones that allegedly violate the

trademarks:

We would like your advice as to whether

they have a case against us.

Thank you.

Re: Allleged Duke Trademark Infringement

The shirts may or may not be a parody but do you really want to fight a giant organization like Duke University? The only way to determine whether they are a parody would be through a Judicial determination in court.
