Legal Question in Intellectual Property in Florida

I have a business that sells products on Amazon, and a brand is trying to find me to file a lawsuit against me. They sent a letter to my home but it was addressed to my wife due to previous associations that she had with the brand, therefore they think she is selling their products online. But my wife does not sell on amazon, nor has she bought any products from this brand. How do I protect my business from getting this lawsuit? How can I protect my address and business name from getting found by this brand? Do they even have a the right to file a lawsuit if Ive never even signed a contract with them? Im getting their products from a distributor that gets them from the main source, so twice separated from the source itself.

You may have some liability. It really depends on your agreement with your distributor, what products you are talking about as well as the main source. Please call my office to discuss further.

Without seeing the letter or knowing why they are suing you (the exact reason), I cannot properly answer your questions. In addition, if your wife's name is on documents and it was not changed or deleted, then she may be responsible. You need to speak to a Business attorney. You may call this office if you desire (954-414-0435), but if not, then I recommend you see a business attorney of your choice right away so you and your business don't get served with a complaint, unless they already have. If they have, then you only have a certain amount of days to answer, and if you don't answer within that time limit, they win by default. Act quickly.
