Hi. I’m hoping someone can give me some info about copyright laws on homemade crafts. I took an idea from a DIY show but made a completely different ( and what I thought was an original) design , but after looking around I found out that someone sells a pattern for something very similar on Etsy. The problem is that they have all this stuff about copyright on their website, and charge a $70 fee for small scale distribution. I never used their pattern for anything, but I’m not sure if this is something I need to pay in order to sell my things. Any help or suggestions would be greatly appreciated. I’m really flying blind with all of this. Thanks.
Any attorney will say copyright does not protect designs. The issue is whether they have a design patent or not. Consult with a good business attorney in your area for specific advice.
