Can you be sued for selling pictures with celebrities photoshopped in the background?

Yes.

Celebrities have the right to control the distribution of their images. Thus, if you put Tom Hanks in a beach scene where Tom Hanks wasn't, Tom can haul you into court and may win, especially if the scene depicts something � anything at all � with which Tom does not want to be associated. For example, if you put Tom's smiling face on Rep. Paul Ryan's body chatting pleasantly in a strategy session with Mitt Romney, Tom, an avowed Barack Obama supporter, wouldn't be happy about it.
